Terms of Service
These terms govern your use of the Cyber Coach iOS application, published by Rising Tide Cyber. By downloading or using the app, you agree to them. They're written to be readable — if anything is unclear, email paul@risingtidecyber.com.au.
1. The licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Cyber Coach on iOS devices you own or control, for your own personal use. You may not redistribute, sublicense, or resell the app.
2. What the app is — and is not
Cyber Coach is an educational self-assessment and coaching tool. It helps you understand your personal cyber-security habits by walking you through plain-English questions and suggesting practical steps to improve.
It is not a substitute for professional security advice, a security audit, a guarantee of safety, an insurance product, or a managed service. The suggestions the app produces are general guidance only. We do not warrant that following them will prevent every security incident, scam, or loss.
3. Your responsibilities
- Answer the questions honestly so the guidance you receive is useful to you.
- You are responsible for the security of the device the app is installed on, including your passcode and biometric protections.
- You must not attempt to reverse-engineer, modify, or interfere with the app, or use it for any unlawful purpose.
- Use your own judgement before making changes to your accounts or devices, and keep your own backups before changing important settings.
4. Updates and changes
We will continue to improve the app, which may include updating questions, guidance, scoring, or the ranks you can earn. We may also discontinue features at any time. We aim to give reasonable notice of material changes, but cannot guarantee that specific versions will remain available.
5. Educational content
The app references widely accepted cyber-security practices and may refer to publicly available guidance from security bodies. Any such material remains the intellectual property of its respective owners. The app's interpretation and wording is our own and is provided for general education.
6. No warranty
The app is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Cyber security is a fast-moving field; we work to keep the app's content current but cannot warrant that it always is.
7. Limitation of liability
To the maximum extent permitted by law, Rising Tide Cyber will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the app — including any loss arising from a security incident, scam, or data loss, regardless of whether you completed a check-up or followed the suggestions.
Nothing in these terms limits any rights you have under the Australian Consumer Law or any other non-excludable consumer protection laws applicable to you.
8. Termination
You can end this agreement at any time by deleting the app from your device. We may terminate or suspend your access if you breach these terms or use the app in a way that harms us or other users.
9. Governing law
These terms are governed by the laws of Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of Australia, except where mandatory consumer protection laws give you the right to bring proceedings in your local jurisdiction.
10. Apple's terms
The app is distributed through the Apple App Store. Your use is also subject to Apple's Licensed Application End User License Agreement. Where there is a direct conflict, these terms take precedence to the extent permitted.
